Child support cost, or the amount that you may have to pay, is based on specific guidelines. In New York the guidelines state that child support cost is to be divided 50/50 between the parents of the child. Whichever parent is determined to be the custodial parent or who is the one paying the main expenses for the child is the one who receives the support. Even when both parents share custody (known as joint custody) a judge may order support to be paid by a parent when that parent’s income level far exceeds the level of the custodial parent. 

Child support is based on the income level of both parents so that the amount to be paid is fair to both parents and the child. The judge will base their formula on the net income of the parents. The judge would subtract any taxes, health care expenses and other mandatory expenses to arrive at the parent’s net worth. The judge will also take in to account the other expenses that the paying parent may have including other children within their home.

Determining Child Support Costs in New York

Once the net worth is determined, the judge would then look at how much time each parent spends with the child, how many other children must be supported between the parents and any special circumstances (medical needs, education, travel or accustomed living expenses of the child.)  When one parent is awarded physical custody, they are the custodial parent. They are then already seen as the parent who is spending more time with the child and paying a majority of the child’s expenses. Therefore, the custodial parent will most likely automatically be awarded financial relief in the form of child support, by the non-custodial parent.
