Paying Child Support
When a parent is determined to be the non-custodial parent in a custody dispute, or if the parent’s income level far exceeds the income of the other parent, he/she may be ordered to pay child support. Child support is awarded in order for a child to receive the financial support they deserve from both parents. The money obtained through child support is used for the child’s medical care, dental care, housing, food, clothing, education and any other required care. Since the child is living with one parent and being provided for most of the time by that one parent, the other parent must contribute as well. Even when joint custody is awarded, if the custodial parent’s income is far lower than the non-custodial parent’s income, the non-custodial parent will likely have to still pay child support.
Parental Rights & Child Support in New York
When you are a parent asked to pay child support by the courts, you must do so according to the arrangement set in place by the family law judge. If you refuse to pay or fail to pay, then you are in violation of the child support agreement and may be held in “contempt of court”. You must then make a court appearance in order for a judge to review the arrangement already set forth and you will be asked to bring your child support account current, also known as paying “arrears,” immediately. If you do not do so, the judge may impose penalties against you that can include: up to 1 year in jail, fines, community service, driver’s license suspension, probation and parole. In addition, any back child support (arrears) must still be paid regardless of the penalties enforced.
