There are different types of child custody that can be awarded in court. The judge will always take in to account both parents' emotional and financial stability and ability to raise a child, including what is in “the best interest of the child”. The judge will award one or both parents physical and legal custody. When parents are awarded custody together, this is called joint physical custody and/or joint legal custody. Both parents would then be “custodial parents” because the parents equally share custody and must agree regarding where the child lives and any legal decisions concerning the child as well. 

If both parents are not awarded physical and/or legal custody together, only one parent will be the custodial parent and the other will be the non-custodial parent. In this case, physical custody is not shared equally, but legal custody may or may not be. Legal custody involves legal decisions that are made by a parent on the child’s behalf. When only one parent is awarded legal custody then they do not need the other parent’s permission to decide on the child’s education, religion, medical needs and any other legal decisions. This can become very problematic when one parent has strong beliefs over the other that may come into play when the child is ill or in need of extreme medical care.

When a parent poses problems to a child's wellbeing (as in being abusive, having a drug or alcohol dependency or mental issues) the court will award sole physical custody and/or sole legal custody to the parent who is fit. When this is the case the unfit parent may not be allowed to see or spend time with their child at all, or in some instances only under the watchful eye of a person appointed by the courts, otherwise known as "supervised visitation."
